Terms of Service

1. Acceptance of Terms

By accessing or using the Hydrolink Smart Water Metering Platform ("Platform"), including the web portal, mobile applications, APIs, and associated hardware devices (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.

These Terms apply to all users of the Platform, including landlords, water utility operators, county governments, NGOs, and administrators.

2. Description of Services

Hydrolink provides:

• Smart water metering hardware (Hydrolink ATM and Hydrolink Hub product lines)
• A cloud-based dashboard for real-time monitoring, billing, and device management
• Automated tenant billing, SMS notifications, and payment processing integrations
• Data analytics, reporting, and consumption tracking
• Technical installation, support, and maintenance services

3. Account Registration

To access the Platform, you must create an account with accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at info@hydrolinkafrica.com if you suspect unauthorized access.

4. Billing and Payments

• Hydrolink Service Fee: A service fee of KES 20 per cubic metre (m³) of water consumed per household is charged to tenants. This fee is deducted by Hydrolink before remitting landlord water revenue.
• Prepay Balances: Prepaid wallet balances are non-refundable except as required by applicable law.
• Price Changes: Hydrolink reserves the right to modify pricing with 30 days' written notice.

5. Data and Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described therein.

6. Tenant Data

Landlords who enter tenant personal data (name, phone number, email, ID number) into the Platform are responsible for obtaining appropriate consent from tenants in accordance with the Kenya Data Protection Act, 2019. Hydrolink processes such data solely to deliver the Services (SMS notifications, billing, invoices) and does not sell or share it with third parties for marketing purposes.

7. Acceptable Use

You agree not to:

• Tamper with, bypass, or reverse-engineer any Hydrolink hardware or software
• Use the Platform to engage in fraudulent billing or misrepresent consumption data
• Upload malicious code or attempt unauthorized access to the Platform
• Sublicense or resell the Services without express written permission

8. Hardware Warranty & Maintenance

Hydrolink hardware is warranted against manufacturing defects for 12 months from the date of installation. The warranty does not cover damage caused by misuse, power surges, flooding, or unauthorized tampering. Maintenance visits are scheduled during business hours (Mon–Fri, 8 AM–6 PM EAT).

9. Limitation of Liability

To the maximum extent permitted by Kenyan law, Hydrolink shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Services, including loss of revenue due to device downtime or connectivity issues. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate the agreement with 30 days' written notice. Hydrolink may suspend or terminate your account immediately for breach of these Terms. Upon termination, your access to the Platform ceases, and you remain liable for any outstanding payments.

11. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be resolved through arbitration in Nairobi, Kenya, under the Arbitration Act, Cap 49.

12. Changes to Terms

We may update these Terms at any time. We will notify registered users by email or in-app notification at least 14 days before material changes take effect. Continued use of the Services after changes constitutes acceptance.
